Cliff Shaw, Q.C. presents “Unsecured Creditors’ Remedies in Alberta – Selected Aspects” (and the protections provided to debtors). It is about substantive law and social policy. Specific aspects of the topic covered are: the language of unsecured creditors’ remedies; enactments, primarily Civil Enforcement Act and Civil Enforcement Regulation; prejudgment (extraordinary) remedies: attachment order, Mareva injunction, and garnishment (before judgment); judgment enforcement remedies: seizure and sale of personal property, sale of land, and garnishment (after judgment); law of exemptions; recent and ongoing law reform.
